(“Grasshopper Trans,” “Company,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.
Grasshopper Trans Inc. is a motor carrier and transportation services provider located at 7851 Ogden Avenue, Lyons, IL.

Material changes will be effective upon posting, and we may provide additional notice through the Site or by other reasonable means. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms.
You must be at least 18 years old and legally able to enter into binding contracts to use the Site. By using the Site, you represent and warrant that you meet these requirements.

If you submit a form, application, or inquiry through the Site (including driver employment applications, quote requests, or contact messages), you represent and warrant that all information provided is true, accurate, current, and complete. Submission of an employment application does not create an employment relationship or guarantee employment. All hiring decisions are made in accordance with applicable law and our internal policies.
These Terms govern your use of the Site only. Any transportation, freight, or related logistics services provided by Grasshopper Trans are subject to separate written agreements, rate confirmations, bills of lading, broker-carrier agreements, shipper-carrier agreements, or other service-specific documentation between Grasshopper Trans and the customer, broker, shipper, or carrier. In the event of a conflict between these Terms and such separate agreements, the separate agreements shall control with respect to the transportation services.
All content on the Site, including text, graphics, logos, images, photographs, video, audio, software, and the selection and arrangement thereof, is the property of Grasshopper Trans or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Site except as expressly permitted in writing by Grasshopper Trans.
“Grasshopper Trans,” the Grasshopper Trans logo, and related names and logos are trademarks of Grasshopper Trans Inc. You may not use them without our prior written permission.
The Site may contain links to third-party websites or resources. We provide these links for your convenience only. We do not control and are not responsible for the content, products, services, or practices of any third-party site. THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, AND SERVICES
PROVIDED THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE”
BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO
THE FULLEST EXTENT PERMITTED BY LAW, GRASSHOPPER TRANS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, free of viruses or harmful components, or that defects will be corrected. You use the Site at your own risk.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL
GRASSHOPPER TRANS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES,
AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF
PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR ANY CONTENT ON IT.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS (US $100.00).
The above limitations apply to the fullest extent permitted by law and do not apply to liability for transportation services, which are governed by the separate agreements and documents referenced in Section 6 and by applicable federal and state transportation law (including the Carmack Amendment, 49 U.S.C. § 14706, where applicable).
You agree to defend, indemnify, and hold harmless Grasshopper Trans and its affiliates, officers, directors, employees, contractors, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to (a) your violation of these Terms; (b) your use of the Site; (c) any false or inaccurate information you submit; or (d) your violation of any law or the rights of any third party.
These Terms and any dispute or claim arising out of or related to them or the Site shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.
We reserve the right to suspend or terminate your access to the Site at any time, without notice, for any reason, including any violation of these Terms. All provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and any other notices or agreements posted on the Site, constitute the entire agreement between you and Grasshopper Trans regarding your use of the Site, and supersede all prior agreements and understandings, whether written or oral, on this subject.
